North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees, in that
employees were exposed to: a pinch point from unguarded hold downs
on a hydraulic shear.
a)plant, production area - local management has no formal
training for employee's prior to use of the hydraulic
shears. On 4/22/98 an inexperienced employee was using
the Cincinnati Model 120 Shears when his finger was
caught under a hold down and partially amputated.
A feasible and acceptable means of abatement is to initiate an
employee training program in accordance with paragraph 7.1 of ANSI
B11.4-1983
It shall be the responsibility of the employer to institute
training procedures that will ensure the competence of all
personnel associated with the use of the shears. (ANSI B11.4-1983;
