North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to:
a) jobsite, North Raleigh Plant - Nello L. Teer Company, at
their asphalt plant #4, did not take appropriate measures
to stop the operation of the Cat 966D loader when the
rear brakes failed.  The employer allowed employees to
operate the loader with only the front brakes partially
functional which resulted in the loosing control (not
able to stop) of the loader on an incline and the loader
finally coming to a stop when hitting a tree.
Among other methods, one feasible and acceptable abatement to
correct this hazard is to stop operating the loader when the
brake system becomes not operational and repair and test the
brakes by a qualified mechanic before operating the loader.ng
