Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: the danger of being crushed by and/or caught between
equipment in use.
a) Construction site - #20 Hillside Ave., Florham Park, N.J.;
An employee delivering ready mixed concrete to a construction site via a
"Mack" Concrete truck
DM Series 690XS, Truck #1146, License Plate XY 71GW, did not determine
that the ground
conditions could handle its' load. (Reference National Safety Council Data
Sheet I-617-Rev. 82;
Page 2, paragraph b, Page 5, paragraph 13,18, and 20.n). One feasible and
acceptable method
of abatement would be to physically get out and check excavation sidewalls
prior to delivery and
to back up to excavation sidewalls at right angles to assure solid ground
under the trucks' rear
wheels.
An accident occurred on 9/3/98 after the east sidewall of an excavation
failed,  causing
aforementioned concrete truck containing 7 cubic yards of concrete
(weighing approximately
56,700 pounds) to roll over and fall into an adjacent house excavation
that was 19.4 feet wide
x 33.5 feet long x 7 feet deep.
Violation occurred on or about 9/3/98.y
