Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by forklift trucks in the event of a rollover:a)Throughout the Warehouse Area, Employees who operate forklift trucks were not required to wear protective restrain devices (seatbelts), which were provided and recommended by the manufacturer of Daewood Forklifts. Observed on or about 10/29/98. ABATEMENT NOTE:AMONG OTHER MEANS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD WOULD BE FOR THE COMPANY TO REQUIRE EMPLOYEES TO UTILIZE THE SEATBELTS AND REINFORCE THIS REQUIREMENT TO THE EMPLOYEES DURING TRAINING SESSIONS. A)Warehouse:Employees not required to wear seat belts while operating forklifts.
