Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by forklift truck in the event of a rollover: a)Warehouse Area:Employees who operate forklift trucks were not required to wear protective restraint devices (seatbelts) that were equipped on Powered Industrial Trucks and required by manufactures specifications. Observed 5/7/99. ABATEMENT NOTE:AMONG OTHER MEANS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD WOULD BE FOR THE COMPANY TO REQUIRE EMPLOYEES TO UTILIZE THE SEATBELTS AND ADD THIS REQUIREMENT TO THE EMPLOYEES TRAINING PROGRAM.
