Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed between the moving ram and the stationary parts of the compactor: a) Warehouse facility at 100 Hackensack Avenue, Kearny NJ Building 10B: The employer failed to develop a safe methods of work for compactors that prevented tampering/bypassing of the safety feature (interlocks) being taped over and allowing the loading chute door to be open while the compactor cycled. Violation observed on or about 08/19/99. Among other methods, one feasible and acceptable method of abatement to correct this hazard is to implement the following: a) Develop and implement standard operating procedures (SOPs) for the safe work practices to be followed by all employees who operate the compactor. b) Provide training to all employees working with the compactor in the safe methods of work to be followed before assigning them to operate, clean, service, maintain or repair the equipment. Such instruction and training shall include procedures provided by the manufacturer. The employer shall maintain records and the dates of training and monitor the employees' operation to ensure employees adhere to the SOPs. c) Label each control on the compactor panel conspicuously as to the function. d) Install emergency stop controls on the compactor. The controls should be located within 3 feet of the point of operation. e) Inspect all safety interlocks, switches and other protective devices to ensure that these devices are not disabled or bypassed, and not to permit the compactor to be operated unless these devices are fully functional. f) All charging hopper access doors on automatic cycling compactors shall have an interlock system that prevents cycling motion while the access door(s) is open.
