North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)jobsite, employees working on an elevated work platform supported by a motorized forklift, without the platform being secured to lift forks to prevent movement or falling, exposing a 19.8' fall hazard to employees. b)jobsite, employees working on an elevated work platform supported by a motorized forklift, without midrails on guardrail system on either end of platform, exposing a 19.8' fall hazard to employees.
