North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a)Pecan St. Water Tower - on 10/13/98, employees were
exposed to the hazard of being struck by objects that
were propelled through the air by an exploding Key
Houston Blasting Pot that was pressurized with compressed
air.
NOTE:Possible methods of abatement include, but are not
limited to:
(1) Installing a pressure relief valve.
(2) Regulate the compressed air entering the hopper to
a pressure that is determined safe by hydrostatic
testing of the hopper.
(3) Hydrostatic test the hopper at least annually and
remove from service should the hopper not pass the
test.
(4) Replace cam-lock assembly with a nut and bolt
assembly.
(5) Conduct an engineering study on the method to bring
hopper to pressure while mixing the material used
for blasting and institute all recommendations
developed from the study concerning the safe use of
the system.
