North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm:
a)warehouse, the supporting members for the storage racks
used to store such items as shutters, shutter caps and
window headers were bent/damaged and no steps had been
taken to prevent collapse.
Among other methods, one feasible and acceptable method to correct
this hazard includes, but is not limited to: remove employees from
the affected area and perform necessary repairs prior to continuing
production.
