North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)jobsite - employees on an elevated work platform, supported by a motorized forklift, were working 45 feet above the ground without midrails installed between the top edge of the guardrail system and the walking/working level. b)jobsite - employees on an elevated work platform, supported by a motorized forklift, were working 45 feet above the ground when the plywood floor of the elevated work platform was rotted, warped, and contained holes and cracks. c)jobsite - employees on an elevated work platform, supported by a motorized forklift, were working 45 feet above the ground without the platform being secured to the lift forks to prevent movement or falling.
