North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees:
a)at end of processing tanks, and throughout the facility;
employees working on elevated work platforms supported by
motorized forklift without the platform being secured to
the lift forks to prevent movement or falling, exposing
fall hazards below.
b) at end of processing tanks, and throughout the facility;
employees working on elevated work platforms supported by
motorized forklift, without guardrail system, and toe
boards.
c)at end of processing tanks, and throughout the facility;
employees working on elevated platforms (pallets),
supported by a motorized forklift, without a trip/slip
preventive surface.
d)at end of processing tanks, employee working on an
elevated work platform supported by a motorized forklift,
without an operator in the control on the truck while
employees are elevated.
One instance of this violation resulted in a fatality/
accident on 1/17/99.
