Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)The possibility of death, dismemberment, and/or crushing injuries caused by the collapse of pre-fabricated wooden roof trusses which were not adequately secured or braced during installation. On or about August 5, 1998, this employer failed to ensure that approximately 42 trusses, with a combined weight of over 16,000 pounds, were adequately secured and braced in accordance with the Truss Placement Plan or Publication HIB-91 Summary Sheet published by the Truss Plate Institute which sets forth specific temporary bracing standards for wood trusses. Failure to follow these standards did result in a serious structural collapse. While ultimate responsibility for correcting the hazard rests with the employer, given its superior knowledge of the workplace, feasible and acceptable methods to correct this hazard, among others, are to follow the temporary bracing standards in Publication HIB-91 including: (1) making all temporary bracing connections with a minimum of 2-16d nails, (2) installing 2X4 top cord lateral bracing spaced at no more than 6 feet apart, (3) lapping lateral braces across at least 2 trusses, and (4) installing top cord diagonal (45 degree) bracing spaced no more than 9 trusses apart. Abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
