Section 5(a)(1): Powered industrial trucks traveling in the same direction were allowed to pass at intersections, blind spots, or other dangerous locations. a)On or about February 17, 1999, two intermodal lift truck operators traveling in the same direction attempted to pass one another in an area with insufficient lateral clearances to allow for the safety of a train crew member which both operators had previously seen and knew to be working in the area. On or about February 17, 1999, the train crew member was walking in close proximity to his train when he was struck from behind, run over, and killed by one of the intermodal lift trucks. The accident occurred inside an intermodal rail yard located at 5330 Gardner, Kansas City, MO. Abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
