Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing injuries in that the following pieces of
earthmoving equipment were
not equipped with functioning audible back-up alarms:
31226 Intrepid Rd, Macon, MO;
a) landfill area; Caterpillar D8H bulldozer
b) landfill area; Caterpillar 826 compactor
c) landfill area; Caterpillar 627B scraper
While ultimate responsibility for correcting the hazard rests with the
employer, given
his/her superior knowledge of the workplace, feasible and acceptable
methods to correct
this hazard include:
1) Install or repair backup alarms as required by 1926.601(a)(9)(i) which
states
"All bidirectional machines, such as rollers, compacters, front-end
loaders,
bulldozers, and similar equipment, shall be equipped with a horn,
distinguishable
from the surrounding noise level, which shall be operated as needed when
the
machine is moving in either direction. The horn shall be maintained in an
operative condition."
Abatement certification is required for this item - use the CERTIFICATION
OF
CORRECTIVE ACTION WORKSHEET for this purpose.
