THE CITATION ISSUED ON SEPTEMBER 2, 1999 ARE HEREBY VACATED:Section 50-9-5(A), NMSA 1978 (New Mexico Occupational Health and Safety Act): Every employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees. Nurses and technicians throughout the facility were exposed to the hazard of being infected with tuberculosis (TB) through contact with residents who were or may be infected with TB. Feasible and useful abatement methods for reducing this hazard, as recommended by the CDC are: 1)Conduct an annual risk assessment to evaluate the risk of TB transmission so that appropriate infection control interventions are used. 2)Include in the TB exposure control plan written procedures for the transfer of residents who become infected with TB. Please provide the above mentioned in your TB exposure control plan and send copies of the risk assessment and written procedures for the transfer of infected TB residents, as proof of abatement.
