NYSLL Article 2, Section 27-a.3.a(1):  The employer did not furnish to
each
of it's employees,
employment and a place of employment which was free from recognized
hazards that are causing
or were likely to cause death or serious physical harm to it's employees
and which will provide
reasonable and adequate protection to the lives, safety or health of it's
employees.  In applying
this paragraph, fundamental distinctions between private and public
employment have been
recognized.
a)Hilton High School employees are exposed to the hazards associated with
bomb
searches, which include but is not limited to fire, explosion, death and
smoke
inhalation. Employees had not received training informing them of their
responsibilities during a search and procedures to protect themselves
during an
emergency event.
Reasonable and adequate abatement methods would include, but are not
limited
to:
A)Prior to an incident, school officials will conduct pre-emergency
planning and coordination with outside agencies. Communicate
safety and health concerns with personnel responsible for
performing school searches.
B)Inform employees of their responsibility during an emergency
event and procedures for self protection.
C)Procedures to account for all employees after emergency
evacuation has been completed.
D)Procedures to be followed by employees who remain to perform
(or shut down) critical plant operation before evacuation.
E)Detail in writing the methods of communication, and lines of
authority during an event.
F)Ensure employees understand the written plan and make available
to all employees the completed plan, a copy should be kept where
employees can refer to the plan at convenient times.
G)Develop a training program to inform employees of the schools
emergency evacuation plan, reporting procedures for personnel and
types of potential emergencies.
