NYSLL Article 2, Section 27-a.3.a(1): The employer did not furnish to each
of it's employees,
employment and a place of employment which was free from recognized
hazards that are causing
or were likely to cause death or serious physical harm to it's employees
and which will provide
reasonable and adequate protection to the lives, safety or health of its
employees. In applying
this paragraph, fundamental distinctions between private and public
employment have been
recognized.
a)Correctional Officers, during the coarse of their assigned duties,
are exposed to the safety hazard of assaults by inmate while patrol
A, B, C, and D yard areas, without adequate lighting such that
wall post officers can provide protection with equipment provided.
One reasonable and adequate protection method would include:
1) Provide uniform lighting in yard areas with consideration to
tasks to be performed by wall post and yard patrol officers, of
such intensity as is specified by the consciences standard
