KRS 338.031(1)(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a.The electrical switch to the hoistway door of the dumb-waiter used to transport food and materials from the first floor to the second floor of the Establishment, had been disconnected, allowing the dumbwaiter to run with the hoistway door in the open position, exposing employees to the hazard of moving parts.
