Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to fall hazards while working from an elevated work platform performing framing activities. The work platform, elevated to a height of 14 feet on the forks of a Gradal Material Handler #524D forklift had not been designed so that the forks could be position so as to pick up the platform in a stable and secure position. The 4 foot wide by 8 foot long platform was constructed with plywood. No other means of fall protection was provided. a) At 16950 E. Ohio, Aurora, CO: Marathon Builders, Inc., as controlling contractor, did not ensure their subcontractor's C.P.M.V., employees were protected from injury in that, employees were performing framing activities on a job-made platform with a fall in excess of 14 feet. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to follow, in accordance with ANSI B56.1-1975 by either repair or replacement. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
