Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to : (a) falls from approximately 13 feet while working on an unsecured, unguarded wooden pallet that had been raised in place by the forks of a "LULL" rough terrain forklift. Among other methods, one feasible means of abatement to correct this hazard is to design and build a safety platform as stated in ANSI B56.6 - 1992.
