Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to a hazard of being run over by equipment while riding on the step of a moving front end loader, while performing highway activities. a) At All Rite Paving & Redi Mix, Inc., as controlling and exposing contractor, employees were exposed to injuries in that, employees were performing Highway activities while riding on the step of a John Deer 210 4X4 serial #T0210CE783986 front end loader. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to train on operation criteria for employees on the proper place for employees to ride equipment as to prevent possible employees being run over by equipment. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
