Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Banberry High Bay - On or about 9/29/98 at the edge of the building on three sides no guard rails was provided to prevent a person from falling to the lower level. The lower level was measured to be in excess of 20 feet. Among other methods, one feasible and acceptable method would be to stretch a cable at the edges, at all three sides. The cable would be anchored at different points along the sides to afford protection from deflection. Such barrier would have a mid cable.
