Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)At the Phipps construction site located at Buckhorn & County Line Rd.,
Hwy 21,
Oxford, Al., two employees were lifted out of a 16 feet deep excavation in
the
bucket of a Komatsu PC 150 LC Track-hoe, exposing them to the hazard of
being
crushed between the bucket and the excavation wall or falling from the
bucket to
the bottom of the trench.
Among other methods, one feasible and acceptable method to correct this
hazard
is to ensure that employees are provided with a ladder that extends three
foot
above the trench and instruct the track-hoe operator that employee's are
not
allowed to ride in the bucket.
