Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard by climbing the guardrail of scissor lift. (a)At the Boulding Metal Building construction site located at 2094 County Road 21, Scottsboro, AL., an employee was not provided fall protection while exiting (Climbing out of and back into) a scissor lift. Employee was exposed to a fall hazard of more than 20 feet to the ground level. Among other methods, one feasible and acceptable method would have been to ensure the required use of a safety net system, or personal fall arrest system.
