Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of death by falling thirty (30) feet.
a) Met Life Building - Two (2) employees were observed hoisting and
traveling with two
(2) metal pipes on top of the standard railing.  The scissors lift was a
JLG 33RTS, serial
number 0300440P00TP2459,The pipes were twenty one (21) feet long eight (8)
inches
in diameter and weighing approximately 390 pounds each.  The manufacturer
prohibits
the use of the railing to hoist material but does make an attachment for
the purpose. The
manufacturer also prohibits carrying "supplies or tools which extend
outside the platform
are prohibited."  The overall length of the lift is twelve feet five
inches (12'-5") and the
pipe carried is twenty one feet (21') long.  Eight feet seven inches
(8'-7")
hung over the
length of the lift. This hazard exposed the employees to the potential of
death.
One feasible and acceptable means of abating the hazard is to follow the
manufacturers
recommendation for the safe handling of material.
Abatement certification and documentation required within 10 days after
abatement date.  The
certification shall include a statement that abatement is complete, the
date and method of
abatement, and state that employees and their representatives were
informed of this abatement.
Abatement documentation shall include documents demonstrating that
abatement is complete,
such as evidence of the purchase or repair of equipment, photographic or
video evidence of
abatement or other written records.
