Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falling hoist parts and/or falling loads:
a) Shop Area: The two 5 (five) ton Demag Hoists (Serial Numbers: 94614 and
94615)
were not kept in good repair in that the following deficiencies were
noted: (1) improper
working practices such as performing lifts when the load weight is unknown
and using
the equipment for side pulls without authorization from a responsible
person who has
first determined that the stability of the hoists is not thereby
endangered and that various
parts of the hoist will not be overstresssed (2) industry required
preventative maintenance
and frequent inspections to ensure employee safety from equipment failure
were not
conducted, and records maintained (3) prior to initial use, the hoist was
not
proof tested
by or under the direction of an appointed person and a written report
furnished by such
person confirming the hoists proof tested to 125of its rated load.
Among other methods, feasible and acceptable methods to correct this
hazard are:
1) Inspect the hoists as per ANSI B30.11 and manufacturer's
recommendations.  Written, dated,
and signed inspection reports and records should be made on critical items
and develop a
preventative maintenance log on each hoist.
2) Determine the load weight either through a qualified engineering
evaluation or by means of
a weight load testing device.
3) Change the work method to eliminate side pulls or have a responsible
person determine that
the stability of the equipment is not endangered and that the various
parts of the equipment will
not be overstressed by the action of the side pull.
4) All new hoists should be proof tested prior to initial use and
documentation of such
maintained.
Abatement certification required within 10 days after abatement date.  The
certification
shall include a statement that abatement is complete, date and method of
abatement, and
states employees and their representatives were informed of this
abatement.tives
