Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was permitted to operate a tractor without roll-over protection or fastened seatbelts: (a) Facility Mulch Yard, Ford Tractor, Model 3910, SN C768699 - An employee working as a mulch loader was operating a tractor without roll-over protection or having the seat belt fastened. The employee was exposed to being thrown from, run over, and crushed by the tractor. ABATEMENT NOTE: Abatement may be achieved by installing a roll-over protection system on this piece of equipment and requiring the use of seatbelts whenever the equipment is operated. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.tives
