Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) At the job site, unauthorized employees were riding on the sides of a CAT, backhoe, SN 1WR03831 without a safe place to ride. (b) At the job site, unauthorized employee was riding on the sides of a CAT/HOLT, Frontend loader, SN 5NN0031 without a safe place to ride. Means of feasible abatement include, but may not be limited to: 1) Development of a company policy that will not allow employees to ride on the sides of any and all heavy equipment. 2) If employees have to work in an area that requires transportation, that the company provide a vehicle that provides a safe place for employees to ride.
