Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees
in that employees
were exposed to:
(a)The employer removed the safety devices from the staple guns which
would have
prevented the accidental ejection of staples when the nozzle was not
depressed. This condition
exposed employees to the hazards of being struck by staples from a
pneumatic staple gun used
in the assembly of their product.
This condition could result in the accidental ejection of staple powered
by 100 PSI
and could cause punctures to the skin and/or injury to the eyes.
A reasonable and feasible method of abatement would be to not remove the
safety device from
the nozzle to prevent the accidental ejection of staples.
