North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: falling from equipment a)Millbrook Rd, Shelley Lake, Raleigh NC-employee was riding on the steps of a Caterpillar 416C loader/excavator, driven by an unlicensed 16 year old driver, on the west bound side of Millbrook Road at a speed estimated to be 25 mph or greater. (ref para 4.3 SAE J153 May 87). One possible abatement would be not to permit riders on equipment if there is no manufacturers designated place for the rider.
