North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment free from recognized hazards that were causing or
likely to cause death
or serious physical harm in that employees and employee operated equipment
were exposed to
hazard(s) of being struck by moving vehicles:
Re: ANSI D6.1-1971 or most recent NC DOT supplement
a)Site, north bound lane of Erwin Rd. & Pettigrew St. - where employee was
working from inside articulated boom bucket(11' above asphalt surface)
attached
to parked truck and where appropriate traffic controls were not provided
when
operations were such that signs, signals, traffic cones, light board, and
barricades
did not provide the necessary protection from vehicular traffic in
accordance with
the Manual on Uniform Traffic Control Devices (MUTCD) for streets and
highways.
An acceptable and feasible method of abatement would include the retraining
of employees Re: deployment of traffic control advance warning signs and
other control devices in accordance with applicable MUTCD sections.
