North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to falls greater than six feet due to an
improperly constructed job made ladder:
a)building 200, Higate Townhouses:  two employees were
observed using a job made ladder, constructed without the
use of filler blocks between the cleats, to access the
window opening of the second floor, approximately 10'8"
above the ground Ref: ANSI A14.4-1979, section 4,
paragraph 4.5.2!.
Among other means, one feasible and acceptable abatement method to
correct this hazard is to properly insert filler blocks of the
appropriate size between the cleats.
