North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by 1200 plus pounds load of an underslung 2 ton hoist: a)site, inside Bay 2 - two systems of 2 ton underslung hoists used to lift 1200 pounds or more was mounted on steel I beams without the system being load tested (Reference ANSI B30-16-1.3.2). b)site, outside, spray paint/preparation area - 2 ton underslung hoists used to lift 1200 pounds or more was mounted on steel I beams without the system being load tested (Reference: ANsi B30-16-2.2.2(a)(1). c)site - three underslung hoists with hooks missing latching devices (Reference: ANSI B30-16-1.2.9). d)site - inspections not performed on underslung hoists (Reference: ANSI B30-16-2.1.2 and 2.1.3). One feasible means of abatement is to maintain the hoist to the standards of American National Standards Institute B30.16.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees could fall to a lower elevation: a)site, preparation bay - employee two feet high using two stepladders as a working surface and placing side load on two wooden step ladders by shuffling them when changing position. One feasible means of abatement is to use the step ladders in accordance with standards of American National Standards Institute A14.1-1990.
