North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North
Carolina:  The employer did not furnish to each of his employees
conditions of employment and
a place of employment free from recognized hazards that were causing or
likely to cause death
or serious physical harm to employees, in that employees were exposed to a
fall to a lower
elevation:
a)site-employees installing roofing tiles at a fall height of 28' were
using a locally
made personnel basket, mounted on a Lull model 644B-37 rough terrain fork
lift,
that did not meet all the requirements of paragraph 5.15, ASME B56.6-1992
in
that: the platform was not securely attached to the lifting carriage or
forks (ref
para 5.15(b)), the lifting forks or carriage were not secured to prevent
them from
tilting up,(ref para 5.15(c)), the platform restraining means such as
railings,
chains, body belts (harness) cable and lanyards were not place and
properly
used,
(ref para 5.15(k)).  Also paragraph 8.25 of ASME B56.6-1992 requiring
that: the
platform did not have a slip resistant floor surface (ref para 8.25(a)),
maximum
weight and the empty weight of the platform were not posted on the
platform (ref
para 8.25 (f)(1)&(2)), there were no means to securely attach the platform
to the
lifting mechanism, (ref para 8.25(h)), and there was no means of
attachment for
securing a lanyard or body belt (harness) (para 8.25(l)).
One feasible and acceptable method of abatement, among others, would be to
correct the deficiencies i.e. use only lifts that meet the requirements of
ASME
B56.6-1992.
