North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to caught in/under/between hazards:
a)jobsite - employees were using a 3/8 inch, grade 43 high
test carbon steel chain, for overhead lifting, in lieu of
grade 80 alloy steel chain, which contributed in an
accident that occurred on 9/16/98.
One feasible and acceptable method, among others, to correct this
hazard is to assure that equipment to be used is tested and
approved for use by ASTM 413/A 413M-96, Standard Specification for
Carbon Steel Chain.

employees were exposed to caught in/under/between hazards:
a)jobsite - employees exceeded the working load limit of
the 3/8 inch, grade 43, high test carbon steel chain by
200 to 400 pounds while lifting the 90 x 94 inch concrete
transformer pad, which contributed to an accident that
occurred on 9/16/98.
One feasible and acceptable method, among others, to correct this
hazard is to assure that equipment to be used is tested and
approved for use by ASTM 413/A 413M-96, Standard Specification for
Carbon Steel Chain, Chapter 9, Table 2.

and Health Act of North Carolina:  The employer did not furnish
each of his employees conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to caught in/under and between hazards:
a)jobsite - employees using improper rigging to lift a 90
x 94 inch, 5600 to 5800 pound concrete transformer pad,
which contributed to an accident that occurred on
9/16/98.
One feasible and acceptable method, among others, to correct this
hazard is to assure that employees are adequately trained on the
correct procedures and equipment for lifting the pad as referenced
in the literature listed below:
