North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falls of heights 10-15 feet while riding on the forks of a rough terrain forklift (ref para 5.15.1(a), ASME 56.6-1992): a)site-employees of Luck's Welding Service were being lifted the heights of up to 15 feet while standing on the forks of a Lull model 844C-42 rough terrain fork lift. Employees were not provided with a platform that complied with Part III of ASME B56.6-1992. One possible abatement is require sub contractors to use approved means to transport employees to work levels.
