North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees:
a)falling to lower elevation - employees working from Yale,
Type E, Order Pickers at height up to 16 feet were
exposed to fall hazards when they used Miller Equipment
10 feet retractable lanyards in lengths in excess of 5
feet.
One feasible and acceptable abatement method, among
others, to correct this hazard is to equipped the Yale,
Type E, Order Pickers with 5 feet lanyards and/or with
equivalent fall protection.
