North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to hazard of being struck by on-coming traffic. a)jobsite, US Hwy. 70 West - October 1, 1998, employees were exposed to the hazard of on-coming traffic when an employee was struck by a vehicle traveling west on US Hwy. 70. The employer did not ensure that employees on the site had the proper placement of warning or alerting work vehicles (equipped with activated flashing or revolving beacons) when used in lieu of signs and channelizing devices. Employee wearing high visibility vest underneath a back pack sprayer such that the vest could not be effectively seen by passing motorists. (REF. NCDOT Workplace Safety Manual and NCDOT Safety Policy and Procedural Manual 1993.)
