General-duty citation text
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to wood dust/flour in a wood working facility: a)site - interior surfaces near wood working machinery with build up of (over 1/8 of an inch) of wood flour and wood dust. Lumber laying flat and stored next to wood working machines with up to 3 inches of wood flour and wood dust on surfaces (reference: NFPA 664-1991 2-5.1). b)site - provisions were not made for systematic, through cleaning of the entire plant at frequent intervals to remove the accumulations of finely divided wood that might be dislodged and lead to an explosion. Wood dust and flour up to 3 inches high was located through out the plant some had recently accumulated and other areas had wood flour that had accumulated over years (reference: NFPA 664-1991 4-1.3). c)site - no maintenance program for all air moving equipment requiring periodic inspection over the entire length, from entrance to exhaust hood for duct system to point of discharge was implemented. The Grizzley exhaust systems at individual wood working equipment did not have a maintenance program (reference: NFPA 91-1991 2-3.1.1).
