North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees, in that
employees were exposed to: fall hazards associated with an elevated
employee work platform installed on the forks of a rough terrain
fork lift truck Reference ANSI B56.6-1992.
a)site, south end of building, employees installing metal
bracing and siding at a height of 9' above the uneven
muddy ground from a personnel platform, approximately 10'
long x 3' wide, on the forks of a rough terrain Skytrack
8042 forklift truck with the following conditions:
personnel platform was not secured to forks, the operator
had left the controls and the wheels were not chocked, no
midrails on the sides of platform, and the platform was
not lowered to the ground to allow an employee to enter
same, reference ANSI B56.6-1992, paragraphs 5.15.1 (b),
(k), (s), (w).
Among other methods, one feasible and acceptable
abatement method to correct this hazard would be to
comply with ANSI B56.6-1992, paragraphs 5.15.1
