North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish to
each of his employees  conditions of employment and a place of
employment free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees, in that
employees were exposed to suspended loads held by overhead hoists:
Frequent visual examinations by the operator or other designated
personnel, were not performed on a monthly basis for hoists used
under normal services (reference ANSI B30.16-1981 (16-2.1.1)):
Periodic visual inspections by appointed person, who makes records
of apparent external conditions, was not performed annually for
hoist used under normal service, to provide the basis for a
continuing evaluation (reference ANSI B30.16-1981 (16-2.1.1)):
a)engine rebuild room - an electric powered 2 ton Budgit
overhead, underslung hoist mounted on steel I-beams used
to lift engines was not inspected frequently or
periodically.
b)steam ginny room - an electric powered 1/2 ton Budgit
overhead, underslung hoist mounted on steel I-beams used
to move small engine parts was not inspected frequently
or periodically.
ABATEMENT NOTE:
The frequent inspection should include the requirements of
ANSI B30.16-2.1.2 which includes checking the operating
mechanisms, checking the hooks and chains and latches for
damage.  It is recommended that frequent inspections be
recorded.
The periodic inspection should include the requirements of
ANSI B30.16-2.1.3 which includes checking the motor or load
brake for external evidence of excessive wear and checking the
suspension bolts, shafts, gears and rollers for signs of
cracks or corrosion.  Periodic inspections need to be
recorded.
