North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were riding/walking 30 feet above the ground from forklifts of a rough terrain forklift without the use of a personnel platform: jobsite -- employees were using a Skytrak model l0054 rough terrain forklift with homemade extensions attached to the forks, to lift roof trusses to the 3d floor for installation. Employees without fall protection, were riding up to the 3d floor while standing on the roof trusses being lifted by the forklift. Employees were not provided with a personnel platform which complied with the design requirements listed in Part III of ASME B56.6-1992.(Ref. ASME B56.6-1992 Sec. 5- 15.1). One feasible method of abatement, among others, is to have the employees use the stairs that were available for their use.r
