Title 21 V.S.A. chapter 3, subchapter 5, Sec. 223(a), section 5(a)(1) of the occupational safety and health act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: crushing injuries caused by a worn swing arm bushing on a hydraulic vehicle lift. Location: Left service bay. Violation: Regular inspection and maintenance was not performed on the single post hydraulic vehicle lift, resulting in excessive wear of the right rear swing arm bushing, and exposed employees to severe crushing injuries and death, due to premature arm failure. Among other feasible methods to correct this hazard... Lock out the lift, order and install the necessary repair parts, and initiate an inspection and maintenance schedule.
