Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about 1-13-99, at the job site, the employees of D & L Towing were exposed to crushing hazards in that the employer was using a piece of steel with a bungie cord to prop a hydraulic lift for automobiles rather than a proper dog leg safety device feature that is sold with the hydraulic automobile lift. The rating for weight of this steel pipe is not known and there are no anti-slip features in place when using the pipe - (other that the bungie cord). Among other methods, one feasible and acceptable abatement to correct this hazard is to replace the manufacturer's safety device on the hydraulic lift.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazard of being struck by ruptured plastic piping, in that, PVC pipe was installed in the shop area to distribute compressed air from the compressor, on or about 1-13-99. Among other methods, one feasible and acceptable abatement method to correct this hazard is to replace the installed PVC piping with an impact resistant acrylonitrile styrene (ABS) pipe or its equivalent.
