Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to the
employees in that employees working in close proximity to the Patterson
Wet-Ball Mill were
exposed to the hazards of being struck by sections of the Wet-Ball Mill
which failed on or about
1-22-99. An attributing factor to the failure of the mill was compressed
air was being applied
to the system to force the slurry upward to the slurry tank.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
would be to utilize a gravity system to transfer the silica slurry from
the Wet-Ball Mill to the
slurry tank.

employees in that employees were exposed to PVC pipes that were
transporting compressed air
and were not approved for that purpose.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
would be to install metal pipe to transport the compressed air. Another
method would be to
install the only type of plastic pipe that has been approved for use with
compressed air, that pipe
is Acrylonitrile-Butadiene-Styrene (ABS), this ABS marking will be labeled
on the pipe.
