Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: hazard of being struck-by and/or crushed-by loads at the worksite known as Pines Trailer, Division of Great Dane Limited Partnership, 1925 Harbor Front Road, Greenville, MS 38701, where below-the-hook lifting devices, i.e., lifting beams/spreader bars used to pick up bundles of rails, side walls, finished trailer for bogie placement and edge clamps used to pick up floors, did not have the rated load marked on the lifters, nor was a nameplate or other permanent marking displaying the manufacturer's name, serial number, lifter weight, and rated load affixed to the lifters. (Reference ANSI/ASME B30.20-1993, Below-The-Hook Lifting Devices, Chapter 20-1, Section 20-1.2.1(a) and (b). Among other methods one feasible and acceptable method to correct this hazard is to prohibit employees from working or reaching under hoisted loads and affix identifying information to the lifting devices.
