Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a)Jobsite (north side of I-10) - On or about May 26, 1999 an employee was observed spray painting the post of an advertisement board approximately 15 feet high while standing in the bucket of a John Deere (790D - LC) excavator. Feasible Abatement: (1) Prohibit employees from standing in the bucket of machines; and (2) Provide and use appropriate manlifts.
