General-duty citation text

NYSLL Article 2, Section 27-a.3.a(1):
The employer did not furnish to each of its employees employment and a
place of
employment which were free from recognized hazards that were  causing or
were likely to cause
death or serious physical harm to its employees and which will provide
reasonable and adequate
protection to the lives, safety or health of its employees. In applying
this paragraph, fundamental
distinctions between private and public sector employment have been
recognized.
1.Employees were being exposed to exhaust contaminants (including unknown
quantities
of dioxins) from malfunctioning crematoria through ongoing episodes: the
employer
failed to evaluate employee exposure to such recognized carcinogens in
spite of numerous
requests from employees and generally accepted practice of zero level
exposure to
carcinogens;
2.Exposure to dioxins can result in serious illness and injury: cancer and
teratogenicity,
respectively;
3.the hazards of exposure to dioxins are recognized and well documented by
NIOSH (the
National Institute of Occupational Safety & Health), and dioxins are cited
by IARC,
NTP, NIOSH, and EPA (among other agencies);
4.There are reasonable and feasible methods for controlling/preventing
exposure to dioxins
in this setting: these include ventilation, temperature, and loading
design criteria which
are standard for the industry; adequate operator training; a scheduled
maintenance
program; and at least initial assessment of emissions.
(a)The employer failed to insure that the crematoria in the School of
Medicine and
Biomedical Sciences were designed and operated in a safe and healthful
manner in
accordance with standard industry practice. Management did not respond to
employee
requests for assistance. Management further failed to follow the
recommendations of the
New York State Department of Environmental Conservation (namely, that the
crematoria
should be equipped with standard equipment such as adequate temperature
gauges,
temperature interlocks, and proper ventilation devices). Management did
not follow the
criteria and standards established by the Federal Environmental Protection
Agency. Note:
Dr. John Wright, Dean of the School of Medicine and Biomedical Sciences,
has
responded favorably to this inspection and has initiated corrective action
based upon the
Federal EPA criteria and standards.
