North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that employees were exposed to:
a)the hazard of being struck by and pinned beneath the Clark powered
industrial
truck (no serial number/model could be determined) due to the absence of an
active operator restraint system or seat belt, prior to and on October 26,
1998.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard would be the installation of the seat belt retrofit kits made
available
to the public by the powered industrial truck manufacturer and requiring
the
operator to wear same.
