Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to hazards while trimming trees:
(a)Employees trimming trees were exposed to the hazards associated with
being struck by
a chain saw due to the handling of the chain saw with one hand while
holding onto the bucket
of a backhoe with the other hand, resulting in the inability to maintain
hand contact with the
saw's chain brake and inadequate control of the saw in the event of a
kickback.
Among other methods, one feasible and acceptable method to correct this
hazard is providing
a work platform which allows both hands to be used on the saw, and
instructing employees in
the appropriate use of chain saws and enforcing the use of saws in
accordance with ANSI
B175.1, "American National Standards for Power Tools - Gasoline-Powered
Chain Saws - Safety
Requirements."ed

(a)Employees trimming trees while standing in the bucket of a backhoe were
exposed to the
hazards of fractures and crushing injuries from being thrown to the ground
due to the hydraulic
system failure, control failure, or other unexpected lowering of the
bucket or from being thrown
from the bucket and struck by the backhoe while being transported in the
bucket without a
passenger restraint device or due to being unrestrained in the bucket and
having unexpected
movement of the backhoe while not attended by the operator.
Among other methods, one feasible and acceptable method to correct this
hazard
is the
prohibition of employees standing in the backhoe bucket and the use of an
appropriate personnel
lifting device.
